9.2 The customer is bound to allow us to check the defec\u00adtive goods. When a defec\u00adtive object has been deliv\u00adered, the customer has the choice of a claim to subse\u00adquent improve\u00adment of the defec\u00adtive object or replace\u00adment deliv\u00adery. Only if a subse\u00adquent improve\u00adment or first replace\u00adment deliv\u00adery fails, the customer can assert his right to with\u00addraw from the contract (rescis\u00adsion) or reduc\u00ading of the purchase price (reduc\u00adtion). In the case of a subse\u00adquent fulfil\u00adment, the customer is however bound to return the defec\u00adtive object as well as pay compen\u00adsa\u00adtion for the bene\u00adfit of use.<\/p>\n

The contract parties are however aware of the fact that it is not possi\u00adble, accord\u00ading to the present state of the art, to exclude errors in the end-prod\u00aduct under all appli\u00adca\u00adtion condi\u00adtions. Tech\u00adni\u00adcal char\u00adac\u00adter\u00adis\u00adtics and descrip\u00adtions in produc\u00adtion infor\u00adma\u00adtion alone do not present any assur\u00adance of certain features, inso\u00adfar as they have no effects on qual\u00adity and usabil\u00adity of the objects. There\u00adfore, custom\u00adary devi\u00ada\u00adtions remain reserved. An assur\u00adance of char\u00adac\u00adter\u00adis\u00adtics is only given in the legal sense if the respec\u00adtive infor\u00adma\u00adtion was confirmed in writ\u00ading by GTS. The liabil\u00adity of GTS is exclu\u00adsively based on the agree\u00adments made in the previ\u00adous section. This is not valid in case of gross fault or intent.<\/p>\n
10.2 The liabil\u00adity limi\u00adta\u00adtion applies to contrac\u00adtual as well as non-contrac\u00adtual claims.<\/p>\n
10.3 All deliv\u00ader\u00adies to commer\u00adcial resellers are subject to the reser\u00adva\u00adtions of correct and timely self-deliv\u00adery. A deliv\u00adery period begins as soon as all order condi\u00adtions were agreed on. It extends, regard\u00adless of our rights with customer delays, by the time which the customer is in delay. Partial deliv\u00ader\u00adies are basi\u00adcally permit\u00adted and bind the buyer to accept, unless some\u00adthing else was expressly agreed on during the contract conclu\u00adsion.<\/p>\n
