9.2 The custo\u00admer is bound to allow us to check the defec\u00adtive goods. When a defec\u00adtive object has been deli\u00adve\u00adred, the custo\u00admer has the choice of a claim to subse\u00adquent impro\u00adve\u00adment of the defec\u00adtive object or repla\u00adce\u00adment deli\u00advery. The contract parties are howe\u00adver aware of the fact that it is not possi\u00adble, accor\u00adding to the present state of the art, to exclude errors in the end-product under all appli\u00adca\u00adtion condi\u00adtions. Tech\u00adni\u00adcal charac\u00adte\u00adris\u00adtics and descrip\u00adtions in produc\u00adtion infor\u00adma\u00adtion alone do not present any assu\u00adrance of certain featu\u00adres, inso\u00adfar as they have no effects on quality and usabi\u00adlity of the objects. There\u00adfore, custo\u00admary devia\u00adtions remain reser\u00adved. An assu\u00adrance of charac\u00adte\u00adris\u00adtics is only given in the legal sense if the respec\u00adtive infor\u00adma\u00adtion was confir\u00admed in writing by GTS. The liabi\u00adlity of GTS is exclu\u00adsi\u00advely based on the agree\u00adments made in the previous section. This is not valid in case of gross fault or intent.<\/p>\n
10.2 The liabi\u00adlity limi\u00adta\u00adtion applies to contrac\u00adtual as well as non-contrac\u00adtual claims.<\/p>\n
10.3 All deli\u00adve\u00adries to commer\u00adcial rese\u00adllers are subject to the reser\u00adva\u00adtions of correct and timely self-deli\u00advery. A deli\u00advery period begins as soon as all order condi\u00adtions were agreed on. It extends, regard\u00adless of our rights with custo\u00admer delays, by the time which the custo\u00admer is in delay. Partial deli\u00adve\u00adries are basi\u00adcally permit\u00adted and bind the buyer to accept, unless something else was expressly agreed on during the contract conclu\u00adsion.<\/p>\n
